Three Things To Do When Someone Contests The Will

Sometimes someone contests the way an estate is being handled. When you're the executor, what should you do?

The actions of an executor when an estate is contested depends on what is being questioned. Is the validity of the will being questioned? is the interpretation of a provision of the will being argued? Are the post-death actions of the executor coming into question?

Contested estates completely change the ball game. Even though there can be significant red tape in settling an estate, because you're dealing with estate lawyers, heirs, financial institutions and their lawyers, title companies, judges, and courthouse employees, at least you can get things done when all parties are cooperative.

But when you have an uncooperative heir, or someone who formally contests some estate matter, you often wind up with broken and irreparable relationships, with a significant portion of the estate winding up in the hands of the legal system.

Perhaps, but not always, you can avoid lengthy estate disputes by, early in the process, getting all parties on board with open communication and resolution of issues.

The Power of Consistent Communication During Your Case

Organization is essential, but so is staying in steady communication with your legal team. Keeping them updated on new symptoms, appointments, or changes in your daily life helps ensure your case reflects your true experience.

Even small details — a missed day of work, a new prescription, or an updated medical recommendation — can make a meaningful difference. Sharing this information promptly allows your attorney to advocate more effectively on your behalf.

Clear, consistent communication not only strengthens your claim but also gives you peace of mind. When you work as a team and keep everyone on the same page, the process becomes smoother, more efficient, and far less overwhelming.

Tips for Staying Organized During Your Claim

While your attorney handles the legal details, there are steps you can take to make the process smoother and faster. Keep a dedicated folder for all documents — medical bills, appointment notes, insurance correspondence, and receipts.

Maintain a clear timeline of events and any communications related to your case. This helps your legal team respond quickly and strengthens your claim.

Staying organized reduces stress, ensures nothing is overlooked, and keeps you in control of your recovery journey — making the path to resolution clearer and more manageable.

How long can a creditor collect an old debt? 🤔

How long can a creditor collect an old debt?

The answer depends on the type of collection activity:

1. A creditor can file a lawsuit within the "statute of limitations" -- which here in FL, is generally 𝟰-𝟱 𝘆𝗲𝗮𝗿𝘀 from the date of your last payment (unless a different state law applies in your cardholder agreement).

2.  A creditor can report information to the credit reporting agencies for 𝟳 𝘆𝗲𝗮𝗿𝘀 from the date of your last payment.

3. A creditor can informally contact you by letters, calls, etc. to collect a debt 𝗶𝗻𝗱𝗲𝗳𝗶𝗻𝗶𝘁𝗲𝗹𝘆 but, if applicable, must also inform you that the debt is outside the statute of limitations.

If you're receiving informal collection communications by letters, calls, etc., 𝗱𝗼 𝗻𝗼𝘁 𝗺𝗮𝗸𝗲 𝗮 𝗽𝗮𝗿𝘁𝗶𝗮𝗹 𝗽𝗮𝘆𝗺𝗲𝗻𝘁 𝘁𝗼𝘄𝗮𝗿𝗱𝘀 𝘁𝗵𝗲 𝗱𝗲𝗯𝘁 𝗼𝗿 𝗮 𝘄𝗿𝗶𝘁𝘁𝗲𝗻 𝗽𝗿𝗼𝗺𝗶𝘀𝗲 𝘁𝗼 𝗽𝗮𝘆 the debt because that can re-start the statute of limitations.

Navigating Your Claim with Confidence

Filing a claim can feel overwhelming, but you don’t have to go through it alone. Staying informed and communicating regularly with your attorney helps ensure every detail of your case is handled correctly.

Keep records of your treatments, missed work, and daily symptoms — these details can make a real difference in your claim. Ask questions, stay engaged, and don’t hesitate to reach out when you need clarity or support.

Remember, your recovery and your case go hand in hand. The more you stay involved and take care of yourself, the stronger your outcome can be — both legally and personally.

Taking Care of Yourself During the Claims Process

Filing a claim isn’t just paperwork — it’s personal. It often comes during a time when you’re already dealing with pain, stress, and uncertainty.

That’s why self-care matters just as much as your medical care. Take time to:
  • Rest when your body asks for it
  • Stay connected with supportive friends or family
  • Follow your treatment plan, even on tough days
  • Communicate openly with your attorney when you feel overwhelmed
Remember — your claim is important, but your well-being comes first. Healing, both physically and emotionally, helps you move forward stronger — in life and in your case.

The Power of Documentation in Your Case

When it comes to your claim, details matter — and good documentation can make all the difference.

Keep a record of everything related to your injury or condition:
  • Medical visits and treatments
  • Symptoms and pain levels
  • Time missed from work
  • Conversations with doctors or insurers
Even small notes can help your attorney build a stronger case and show the full impact of your injury over time.

Think of it as your personal timeline — one that supports your story with clear, consistent facts.
Good documentation doesn’t just help your attorney — it helps protect you.

Why Keeping Your Attorney in the Loop Matters

Your attorney isn’t just there for court dates — they’re your partner throughout the entire claims process. And one of the most powerful tools you can give them? Clear, ongoing communication.

Whether you’re facing new symptoms, struggling to make appointments, or running into issues with work or finances, don’t keep it to yourself. These details can directly impact your case — and your legal team can often help troubleshoot or adjust strategy as things evolve.

Remember:

Missed appointments? Tell them why.

New diagnosis or complication? Keep them updated.

Feeling overwhelmed or unsure? You’re not alone — they’ve seen it before.

The more your attorney knows, the better they can advocate, protect, and support you.

Your recovery is personal — your legal strategy should be, too.

Why Statements from Friends and Family Can Matter

Not all evidence comes from doctors.

When you're filing an injury or disability claim, statements from people close to you — like family members, caregivers, or coworkers — can paint a clearer picture of how your condition affects daily life.

They can speak to:
  • Changes in your behavior or abilities
  • Tasks you can no longer do
  • The emotional and physical toll your condition takes
These personal insights can complement your medical records and add depth to your case. A skilled attorney can help you gather and present them effectively.

Because sometimes, the people who know you best are your strongest advocates.

The Power of Consistent Medical Treatment in Your Claim

One of the most overlooked factors in injury and disability claims? Consistency in treatment.

Gaps in your medical care can raise red flags — even if you're genuinely struggling. Insurance companies may argue your condition isn’t serious if you’re not seeking regular care.

Staying on top of appointments, following through with prescribed treatments, and keeping a steady record not only helps your health — it strengthens your claim.

If attending appointments is a challenge due to pain, mobility, or finances, let your attorney know. There may be options that can help keep your treatment (and your case) on track.

Documentation Makes the Difference

In injury and disability claims, what you can prove is just as important as what you’re experiencing.

That’s why documentation is everything. Medical records, diagnostic tests, treatment history, and even personal journals detailing your symptoms can all strengthen your claim.

But it’s not just about having documents — it’s about having the right ones, organized and presented clearly.

A knowledgeable attorney can help you collect, prepare, and submit the evidence that supports your case — and avoid delays that could hold up your benefits.

Start early, stay organized, and let your paperwork tell your story.

Denied Benefits? Don’t Give Up Yet

If your injury or disability claim was denied, it’s easy to feel discouraged — but a denial doesn’t have to be the end of the road.

Many valid claims are denied due to missing paperwork, unclear medical records, or missed deadlines — issues that can often be corrected with the right legal help.

An experienced attorney can review your case, gather the right evidence, and guide you through the appeals process. The key is acting quickly — appeals have strict deadlines, and the sooner you start, the better your chances of turning things around.

A “no” today doesn’t mean “no” forever. Don’t walk away without a second opinion.

Can You Receive Workers’ Comp and Social Security Disability at the Same Time?

Yes, in many cases you can receive both Workers’ Compensation and Social Security Disability benefits — but there are rules that affect how much you can receive. The Social Security Administration may reduce your SSD payments based on how much you’re getting from Workers’ Comp. This is called the “offset,” and navigating it can be tricky. A knowledgeable attorney can help make sure your benefits are calculated correctly and that you’re not leaving money on the table.

What Happens If Your Social Security Disability Claim Is Denied?

A denial isn’t the end of the road — in fact, many SSD claims are initially denied. What matters most is how you respond. You have the right to appeal, and there are multiple stages in the appeals process, including reconsideration, hearings, and even federal court if needed. It’s important to act quickly, as deadlines are tight. With legal representation, your chances of a successful appeal are much higher, especially when medical evidence and legal arguments are properly prepared.

Who Qualifies for Social Security Disability Benefits?

Social Security Disability (SSD) benefits are meant for people who are unable to work due to a serious medical condition expected to last at least one year or result in death. To qualify, you must also have a sufficient work history and meet the Social Security Administration’s definition of disability. This process can be complex and frustrating, especially when you're already dealing with health issues. Having legal guidance during your application or appeal can make a major difference in the outcome.

Common Reasons Workers’ Comp Claims Are Denied

You’d think getting hurt at work would automatically mean you're covered, but unfortunately, that's not always the case. Workers’ Compensation claims can be denied for many reasons, including missed deadlines, lack of medical evidence, or disputes over whether the injury was work-related. If your claim has been denied, you still have options. An experienced attorney can help appeal the decision and fight for the benefits you need to recover and move forward.

Injured or Unable to Work? Know Your Rights.

If you’ve been hurt on the job or can’t work due to a medical condition, navigating the legal system can feel overwhelming. But here’s the good news: you don’t have to go through it alone.

Workers’ Compensation is designed to help cover medical bills and lost wages if you’re injured at work. Social Security Disability (SSDI), on the other hand, supports those with long-term conditions that prevent them from working at all.

Each system has its own rules, paperwork, and deadlines—and even small mistakes can lead to delays or denials.

That’s where we come in. Our team focuses solely on these areas, so you get experienced guidance from day one.

Let us help you get the benefits you’ve earned.

Don’t Forget About Digital Assets

Your will likely covers physical property and finances—but what about digital assets?

Think: online accounts, cryptocurrencies, domain names, or cloud-stored photos. These can hold significant value, both emotional and financial.

Include digital instructions in your estate plan and store access info securely. As our lives become more digital, your plan should evolve too.

How Often Should You Review Your Will?

Even if nothing major has changed, it’s smart to review your will every 3 to 5 years. Laws can change, assets can shift, and people in your life may come and go.

Set a recurring reminder, or review it alongside your annual financial checkup. It’s a simple habit that brings long-term peace of mind.

What Happens If You Don’t Update Your Will?

An outdated will can lead to confusion, delays, and even disputes among loved ones. If beneficiaries or asset details are no longer accurate, your estate may not be distributed as you intended.

In some cases, the courts will need to interpret your will—something that can be stressful for your family. A quick review every few years can prevent these headaches and ensure your legacy is protected.

When Should You Update Your Will?

Your will is a crucial document that ensures your wishes are honored, but it’s not a “set it and forget it” item. Life changes can mean it’s time to update your will to reflect your current situation.

Consider reviewing or updating your will after major events like:
  • Getting married or divorced
  • Having a child or adopting
  • Buying or selling significant property
  • Changes in your financial situation
  • The death of a beneficiary or executor
Regular updates help avoid confusion and ensure your assets go exactly where you want. Aim to review your will every few years—or whenever big life changes happen—to keep it current and clear.
